Terms of Service

We wrote these ourselves, in plain language, based on how LeaseSimple actually works today. They haven't been reviewed by a lawyer yet; we're arranging that and will update this page if anything changes as a result.
1. Acceptance
By using LeaseSimple.ca or app.leasesimple.ca (the “Service”) you agree to these Terms. If you don't agree, please don't use the Service.
2. The contracting entity
These Terms are between you and [operating entity, to be confirmed], which operates LeaseSimple.ca and app.leasesimple.ca. You can reach us at bart@leasesimple.ca.
3. What LeaseSimple is, and isn't
LeaseSimple provides general information and tools to help landlords and tenants in British Columbia prepare, e-sign, and store tenancy paperwork, such as the RTB-1 agreement. It is not a law firm and not legal advice, and using it does not create a lawyer-client relationship. Generated documents are drafts built from the information you enter. Review them, and the current rules of the BC Residential Tenancy Branch, before signing or relying on them.
4. Your account
Sign-in is passwordless. Keep access to your email secure, since anyone with it can access your account. You're responsible for activity under your account.
5. Your information
You're responsible for the accuracy of the details you enter and for ensuring your use of any document complies with the law. Only invite people you intend to enter a tenancy with, and only share information you're entitled to share.
6. Payment
Tenants never pay, on anything. If you're a landlord: building and downloading the unsigned RTB-1 is free. Pay once when you send the agreement for signing. That payment covers e-signing through DocuSeal and keeps the executed copy available to both of you once it's signed.
The charge is per rental unit, not a subscription. If the same agreement needs to go out again, for example because the first tenant never signs, sending it again is free, as long as no agreement on that unit has actually been signed yet. If the unit is rented out again after a signed tenancy, sending a new agreement is a fresh charge. Inviting someone else onto an unpaid draft, or replacing the invited tenant before anyone has signed, costs nothing until you send it.
7. Taxes
Displayed prices are tax-inclusive; you won't be charged tax on top of the price shown.
8. Refunds
Because you only pay once you've already built and reviewed the document, and payment is what starts e-signing, refunds are limited to cases where the Service failed to deliver what you paid for, for example if e-signing never became available because of an error on our side. Email bart@leasesimple.ca and we'll sort it out.
9. When signing fails, is declined, or expires
DocuSeal, our e-signature provider, is the source of truth for whether an agreement is signed. If a signer declines, or the signing round runs out of time before everyone signs, nothing is agreed and nobody is bound by it. What you paid isn't lost: you can send the same agreement for signing again, or invite someone else instead, at no extra charge, as long as the unit hasn't already had a signed agreement.
10. Document retention
Once everyone has signed, we keep the executed copy available for download from your agreement for as long as your account exists. We recommend you keep your own copy too, since we can't guarantee availability forever.
11. Consent to electronic delivery and signing
By using the Service to send, receive, or sign a tenancy agreement, you agree to receive that agreement and related notices electronically, and to sign it electronically through DocuSeal. British Columbia's Electronic Transactions Act allows tenancy documents to be created, delivered, and signed electronically, but only where everyone involved has agreed to do it that way. Opening the invite, review, or signing links we send you counts as that agreement.If you'd rather not sign electronically, say so before you start: the free, unsigned RTB-1 PDF can still be printed and signed on paper.
12. Cancellation
You can stop using the Service at any time. A landlord can archive or delete a draft, or an agreement that hasn't been paid for. Once an agreement has been paid for and sent, cancelling stops future reminders about it but doesn't undo or refund what already happened (see Payment and Refunds above). There's no subscription to cancel.
13. Acceptable use
Don't misuse the Service: no unlawful, fraudulent, infringing, or abusive activity; no entering false information about a tenancy or impersonating someone else when you invite them; no attempts to break security or access others' data; and no use that disrupts the Service.
14. No warranty
The Service is provided “as is,” without warranties of any kind. We don't guarantee that documents are complete, current, or suitable for your situation, or that the Service will be uninterrupted or error-free.
15. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for outcomes arising from documents you generate, sign, or rely on. LeaseSimple is not a law firm, and nothing in the Service is a substitute for reviewing your documents and your own situation with a qualified advisor. Nothing here limits liability that can't be limited by law.
16. Changes and termination
We may update the Service or these Terms; material changes will be noted by updating the date above. We may suspend or end access for misuse. You can stop using the Service anytime.
17. Governing law
These Terms are governed by the laws of British Columbia and the applicable laws of Canada.
